How the review works

  1. Answer four questions

When it happened, who caused it, your injuries and any lawyer agreement. Then a name and phone number.

  2. Expect a call

A Georgia law firm’s automated assistant calls and asks a few questions. Call timing depends on availability.

  3. Possible attorney review

The assistant can connect you with the intake team to discuss the next steps.

The records clock

What a trucking company can delete after a crash, and when

Federal rules set the shortest time a carrier must keep each record. Six of these ten can be gone before Georgia’s two-year deadline to sue.

  • Can be discarded before the two-year mark
  • Kept at least two years
  • Georgia’s two-year deadline to sue
  1. Driver vehicle inspection reports
  2. Hours-of-service logs
  3. Roadside inspection reports
  4. Negative drug and alcohol results
  5. Maintenance and repair records
  6. Annual inspection report
  7. Drug and alcohol collection records
  8. Accident register
  9. Driver qualification file
    Job + 3 years 49 CFR 391.51(c)
  10. Positive tests and refusals

A floor, not a shield. These are minimums for normal business. Once a suit is “reasonably foreseeable” to the carrier, Georgia law requires it to keep the evidence (Phillips v. Harmon, 2015). A lawyer’s preservation letter fixes that date.

Carrier check: look up the trucking company

Every interstate carrier has a USDOT number on both sides of the cab (49 CFR 390.21). Type it from the truck or the crash report.

What the snapshot shows

  • Status: active, inactive or out of service
  • Authority to haul for hire, and the number of trucks and drivers
  • 24 months of inspections and out-of-service rates
  • 24 months of reported crashes, with no finding of fault

A high vehicle out-of-service rate points at maintenance records. A high driver rate points at the logs.

How to choose a truck accident attorney in Atlanta

Most firms that rank for this search also take car crashes. A truck case asks for more: federal rules, electronic data and a carrier with its own crash team. Check five things before you sign.

  • The license. Look the lawyer up in the State Bar of Georgia member directory, and scan the bar’s recent discipline list.
  • Week one. Ask when the preservation letter goes out, and whether it names ELD data, the engine module, camera video, dispatch messages and the driver file.
  • Trucking cases by number. Ask how many tractor-trailer cases the lawyer has filed or tried in metro Atlanta or federal court.
  • The fee agreement. Georgia requires it in writing, with the percentage at settlement, trial or appeal and how expenses are handled (Rule 1.5(c)).
  • SB 426. A lawyer who plans a direct suit against the insurer in an ordinary case has missed the 2024 change.

Georgia deadlines, the 50% bar and SB 426

You have two years from the crash to file an injury suit in Georgia (O.C.G.A. § 9-3-33), and four years for vehicle damage (§ 9-3-31). If a city owned the truck, such as a sanitation truck, written notice is due within 6 months (§ 36-33-5); for a county, 12 months (§ 36-11-1).

Fault is shared. Your damages drop by your share of fault, and at 50% or more you recover nothing (§ 51-12-33). Expect the carrier’s side to push your share up.

The insurance is bigger than for a car. A for-hire interstate truck hauling general freight must carry at least $750,000 in liability cover (49 CFR 387.9). But since July 1, 2024, SB 426 limits a direct suit against the carrier’s insurer to an insolvent or bankrupt carrier, or a driver or carrier who cannot be served.

For crashes on or after April 21, 2025, SB 68 lets juries hear seat-belt evidence and see what medical bills were actually paid. It did not change the deadline or the 50% bar.

After a truck crash in Atlanta: the first days

  1. Get the report number. Georgia requires a police report for a crash with injury, death or apparent damage of $500 or more (O.C.G.A. § 40-6-273).
  2. Photograph the cab door. The carrier’s name and USDOT number are on both sides. Add the trailer number and the plate.
  3. Get checked the same day. Grady and Wellstar Kennestone are metro Atlanta’s adult Level I trauma centers.
  4. Let the insurer’s call wait. You do not have to give the carrier’s insurer a recorded statement first.

What the free case review covers

The review asks four questions: when the crash happened, whether another driver caused or contributed to it, whether you have pain or injury symptoms, and whether you have signed with a lawyer for this crash. Then you leave a name and phone number.

It is built for Georgia crashes from the last six months, with injuries, where no lawyer is signed yet. If you are not sure who caused the crash, say so. The intake team clarifies fault.
